These Terms of Service (the “Terms”) govern your use of the website at digitalcoastmarketing.com (the “Site”), operated by DigitalCoast Marketing, LLC (“DigitalCoast Marketing,” “we,” “us,” or “our”), a digital marketing agency based in Mount Pleasant, South Carolina. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Our Services

The Site describes our marketing services, including search engine optimization, paid advertising, web design, social media, video, and reputation management. Content on the Site is provided for general information only. The services we perform for clients are governed by separate written agreements, proposals, or statements of work — not by these Terms. If there is a conflict between these Terms and a signed client agreement, the client agreement controls.

Use of the Site

You agree to use the Site only for lawful purposes. You may not attempt to gain unauthorized access to any portion of the Site or its systems, interfere with the Site’s operation, scrape or harvest data from the Site at scale, or use the Site to transmit malicious code or unsolicited communications.

Intellectual Property

The Site and its content — including text, graphics, logos, images, portfolio work, and the underlying code — are owned by DigitalCoast Marketing or our licensors and are protected by copyright, trademark, and other laws. You may view and share Site content for personal or internal business reference, but you may not republish, reproduce, or use it commercially without our written permission. Client names, logos, and work samples shown on the Site belong to their respective owners.

Software Tools and Third-Party Integrations

DigitalCoast Marketing develops and operates software tools for its own internal business use, including integrations with third-party platforms such as Intuit QuickBooks Online and other business, analytics, and advertising services. These tools are used solely to operate our business and serve our clients; they are not offered for public download, resale, or general use, and no license to them is granted through the Site. Where our tools connect to third-party platforms, your and our use of those platforms remains subject to the terms and privacy policies of their providers. Any internal software is provided “as is,” without warranties of any kind, and we may modify or discontinue it at any time.

The Site may link to third-party websites or services we do not control. Those links are provided for convenience, and we are not responsible for the content, policies, or practices of third parties.

Disclaimers

The Site is provided on an “as is” and “as available” basis. Limitation of Liability

To the fullest extent permitted by law, DigitalCoast Marketing will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless DigitalCoast Marketing and its members, officers, and employees from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Site will be brought in the state or federal courts located in Charleston County, South Carolina, and you consent to their jurisdiction.

We may update these Terms from time to time. The effective date above shows when they were last revised. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
